Terms of Service

1. General Provisions

  1. These Terms of Service ("Terms") define the rules for using the IvyCV service available at ivycv.com ("Service").
  2. The Service is operated by an individual conducting unregistered activity (działalność nierejestrowana) under Article 5 of the Polish Entrepreneurs' Law (Prawo przedsiębiorców) ("Provider").

  4. By using the Service, you ("User") confirm that you have read, understood, and agree to these Terms. If you do not agree, please do not use the Service.
  5. These Terms constitute the "regulamin" required by Article 8 of the Polish Electronic Services Act (Ustawa o świadczeniu usług drogą elektroniczną).

3. Service Description and Use of Artificial Intelligence

  1. IvyCV is an AI-assisted CV creation tool. Users provide their career information (work history, education, skills) and optionally a job listing. The Service uses artificial intelligence to generate a tailored CV document.
  2. The Service uses third-party AI models (including but not limited to Anthropic Claude and Google Gemini) to process User data and generate CV content. All generated CVs are AI-assisted documents.
  3. The Service provides 39 professional CV templates. All templates are available to all Users regardless of payment tier.
  4. CV generation and preview (with watermark) are available free of charge. Payment is required only to download the clean, watermark-free PDF.

4. Account Registration

  1. Account creation is free and optional for preview purposes.
  2. An Account is required to download clean PDFs and to store a Master Profile.
  3. Users register using an email address and password. Authentication is handled by Supabase Auth.
  4. Users must provide accurate information and keep login credentials confidential.
  5. Users may delete their Account at any time from the account settings page. Deletion permanently removes all personal data (see Privacy Policy).

5.2 Payment Terms

  1. All prices are gross prices (inclusive of all applicable taxes).
  2. Currency is automatically detected based on User location: PLN for Poland, EUR for EU countries, USD for all other regions.
  3. Payments are processed by Stripe. IvyCV never sees or stores card numbers.
  4. Accepted payment methods include credit/debit cards, BLIK, and Przelewy24 (available methods depend on currency and region).
  5. Promotional codes may be entered during checkout.
  6. Generation credits from bundle purchases do not expire.

6. Digital Content Delivery

  1. Upon successful payment, the User receives a download link for the clean PDF. The download link is valid for 24 hours and allows up to 5 downloads.
  2. The PDF is generated based on the User's data and selected template at the time of purchase. The content is the same as shown in the watermarked preview, minus the watermark.
  3. Delivery of Digital Content begins immediately after payment confirmation, subject to the User's consent under Section 8.

7. Right of Withdrawal

  1. Under Article 27 of the Polish Consumer Rights Act (Ustawa o prawach konsumenta), implementing EU Directive 2011/83/EU, you have the right to withdraw from a distance contract within 14 calendar days without giving any reason.
  2. The withdrawal period begins on the day the contract is concluded (i.e., the day of purchase).
  3. To exercise the right of withdrawal, you must inform us of your decision by sending a clear statement (e.g., email to hello@ivycv.com). You may use the withdrawal form template, but it is not mandatory.
  4. If you withdraw, we will refund all payments received from you without undue delay and in any case within 14 days of receiving your withdrawal declaration. We will use the same payment method used for the original transaction.

8. Waiver of Withdrawal Right for Digital Content

  1. Under Article 38 point 13 of the Polish Consumer Rights Act, the right of withdrawal does not apply to digital content delivered on a non-physical medium if all of the following conditions are met:
    • The Consumer paid for the digital content;
    • The Consumer gave explicit prior consent to begin delivery before the withdrawal period expired;
    • The Consumer was informed about losing the right of withdrawal upon delivery; and
    • The Provider sent confirmation of the transaction.
  2. During checkout, you will be asked whether you consent to immediate delivery of the Digital Content (generated CV). This consent is voluntary — you may choose to wait 14 days before delivery while retaining your withdrawal right.
  3. If you consent to immediate delivery, you acknowledge that you lose your right of withdrawal once the download begins.

9. AI-Generated Content — Quality and Limitations

  1. CVs generated by the Service are created using artificial intelligence technology. While we strive for high quality output:
    • AI-generated content may contain errors, inaccuracies, or inappropriate suggestions;
    • The Service does not guarantee employment, interviews, or job placement;
    • Output quality depends on the accuracy and completeness of User-provided input data;
    • AI may rephrase, restructure, or summarize User-provided content — the User must verify that the output accurately represents their qualifications.
  2. The Service is not a substitute for professional career counseling, legal advice, or human review by a recruitment specialist.
  3. The User is solely responsible for reviewing, editing, and verifying all AI-generated content before submitting it to potential employers or any third party.
  4. IvyCV is not liable for career outcomes, hiring decisions, or any consequences arising from the use of AI-generated documents.

10. User Responsibilities

By using the Service, you agree that:

  1. You are responsible for the accuracy and truthfulness of all information you provide.
  2. You must not submit false qualifications, fabricated work experience, or misleading information.
  3. You must review all generated content before using it in job applications or sharing with third parties.
  4. You must not use the Service to create fraudulent, misleading, or deceptive documents.
  5. Any use of generated content is at your sole risk and responsibility.

11. Intellectual Property

  1. Your content: You retain all rights to the personal information, work history, skills, and other content you provide to the Service.
  2. Generated CVs: You own the CV documents generated for you by the Service. You may use, modify, and distribute them freely.
  3. Service content: IvyCV retains ownership of the platform, software, AI prompts, templates, design elements, and branding. Templates are licensed for use within generated documents only.
  4. License grant: By using the Service, you grant IvyCV a limited, non-exclusive, revocable license to process your content solely for the purpose of providing the Service (generating and storing your CVs and Master Profile).

13. Complaints Procedure (Reklamacje)

  1. If the Digital Content does not conform to the contract (e.g., the PDF cannot be opened, is corrupted, or does not match the preview), the User has the right to file a complaint.
  2. Complaints should be sent to hello@ivycv.com and must include:
    • User's email address;
    • Description of the issue;
    • Date of purchase;
    • Expected resolution.
  3. We will respond to complaints within 14 days of receipt. If the complaint is justified, we will provide a remedy (repair, replacement, or refund) as required by law.
  4. Under the Polish Consumer Rights Act, the User has a 2-year warranty period for digital content conformity. During this period, the User may request repair, replacement, price reduction, or full refund if the Digital Content does not conform to the contract.

14. Liability and Warranty

  1. The Service is provided on an "as is" basis. To the maximum extent permitted by applicable law, IvyCV does not make warranties regarding the suitability of AI-generated content for any particular purpose.
  2. IvyCV shall not be liable for:
    • Career outcomes, job application results, or employment decisions based on generated CVs;
    • Inaccuracies in AI-generated content that the User did not review and correct;
    • Service interruptions or downtime;
    • Data loss beyond what is covered by our backup and retention policies.
  3. To the maximum extent permitted by law, IvyCV's total liability shall not exceed the amount paid by the User in the 12 months preceding the claim.
  4. Nothing in these Terms excludes or limits liability for:
    • Intentional damage (wina umyślna) under Polish law;
    • Consumer rights that cannot be excluded under Polish or EU law;
    • The 2-year digital content conformity warranty.

15. Data Protection

  1. Personal data is processed in accordance with the General Data Protection Regulation (GDPR) and Polish data protection law. Full details are available in our Privacy Policy.
  2. Your CV data is sent to third-party AI providers (Anthropic, Google) solely for the purpose of generating your documents. These providers are bound by data processing agreements that prohibit use of your data for AI model training.
  3. We use EU regional processing where available to minimize data transfers outside the European Economic Area.

16. Technical Requirements and Compatibility

To use the Service, you need:

Generated PDFs conform to the PDF 1.7 standard and can be opened with any standard PDF viewer. PDFs are designed to be parseable by common Applicant Tracking Systems (ATS) by using standard fonts, text layers, and formatting conventions. Actual parsing results depend on the specific ATS software used by each employer, which varies and is outside our control.

17. Changes to Terms

  1. We may modify these Terms from time to time. Material changes will be communicated to registered Users via email at least 14 days before they take effect.
  2. Continued use of the Service after the effective date of changes constitutes acceptance of the updated Terms.
  3. If you do not agree with the updated Terms, you may delete your Account before the changes take effect.
  4. Changes do not affect contracts already concluded (purchases made before the change date remain under the previous Terms).

18. Assignment

  1. We may assign or transfer our rights and obligations under these Terms to a successor entity (e.g., in connection with a business restructuring, incorporation, or merger).
  2. In such case, we will notify you by email at least 30 days before the transfer takes effect. The successor entity will assume all obligations under these Terms and our Privacy Policy.
  3. You may not assign or transfer your rights under these Terms without our prior written consent.

19. Governing Law and Jurisdiction

  1. These Terms are governed by the laws of the Republic of Poland.
  2. Any disputes shall be resolved by the competent court for the Provider's registered address, except where mandatory consumer protection rules designate a different court (in which case the court competent for the Consumer's place of residence may apply).

20. Out-of-Court Dispute Resolution

  1. Consumers have the right to use out-of-court complaint and redress mechanisms. Information about access to these procedures is available at the Office of Competition and Consumer Protection (UOKiK): www.uokik.gov.pl.
  2. The European Commission provides an Online Dispute Resolution (ODR) platform at: ec.europa.eu/consumers/odr.
  3. Consumers may also contact municipal or county consumer ombudsmen (powiatowi/miejscy rzecznicy konsumentów) for free assistance.
